I. General Provisions

These Terms and Conditions (the „T&C") govern the rights and obligations between the seller Marek Mantič, ID 06722245, Hlavní třída 1023/55, 708 00 Ostrava-Poruba, Czech Republic (the „Seller") and the buyer (the „Buyer") when purchasing goods through the online store tram.photos (the „e-shop").
The e-shop provides photo calendars, printed materials and items or services related to transport themes. If a product is marked as made to order, such goods are produced only after the order is confirmed and according to the specific source files or requirements of the buyer, which should be taken into account before placing the order.
By placing an order or by registering an account the Buyer confirms that he has read these T&C and agrees with them. The T&C are available on this website and form part of the purchase contract.

II. Registration and User Account

Registration through the registration form is available for the extended functions of the e-shop (for example tracking of orders and invoices).
The Buyer is obliged to provide true and up-to-date details: first name, surname, e-mail address, telephone number and, where applicable, delivery address. These details will be used exclusively for processing and delivering the order.
The Buyer is responsible for securing access to his account (password).
The Seller reserves the right to cancel an account that violates these T&C.

III. Subject of Goods

The subject of the sale is photo calendars, printed materials and items produced to order according to the photographs and requirements of the Buyer (the „goods").
The goods are produced individually to order according to the chosen source files. Printing and processing takes place after confirmation of the order.
The current price and offer of goods is stated on the pages of the e-shop.
Goods produced to order are marked in the e-shop. Processing starts after the order is confirmed; the goods are therefore produced according to the selection and requirements of the Buyer.

IV. Order and Payment

The order is made through the order form on the pages of the e-shop.
Before submitting the order the Buyer is informed about the price of goods, delivery and these T&C.
By submitting the order and making the payment the Buyer agrees with these T&C and concludes a purchase contract with the Seller.
The payment is made by bank transfer (QR payment) or through the PayU payment gateway. The Seller does not store the Buyer’s payment details (card numbers etc.); these details are processed exclusively by the payment gateway on a secure server.
After receiving the order it is confirmed. For goods produced to order the contract is concluded by confirmation of the order by the Seller.
The Buyer is issued a tax document (invoice) for the payment, which is available for download in the section „Invoices" in the Buyer’s profile. The invoice is also sent by e-mail after the delivery of the order.

V. Delivery

1. Delivery is carried out by the chosen method:

Zásilkovna – delivery to pickup points in the Czech Republic and Slovakia;
personal pickup – only after prior agreement with the Seller.

2. Delivery costs are stated in the order.

VI. Withdrawal from the Contract and Return of Goods

If the goods are manufactured according to the specific materials, requirements or wishes of the Buyer, or are customized to the Buyer's personal needs, such goods are subject to a statutory exception from the 14-day right of withdrawal pursuant to Section 1837(a) and (d) of the Civil Code.
Therefore, for goods manufactured or modified according to the Buyer's specific requirements, the Buyer may not withdraw from the contract within 14 days without giving a reason, and such goods cannot be returned on this basis.
Goods made to order include, in particular, goods that are manufactured or modified on the basis of the Buyer's individual materials, such as photographs, texts, graphic materials, individual dimensions or other requirements, resulting in goods customized specifically for the Buyer.
For goods that are in stock and have not been manufactured or modified according to the Buyer's specific requirements, a Buyer who is a consumer has the right to withdraw from a contract concluded through the online store without giving any reason within 14 days of receiving the goods, in accordance with Section 1829 of the Civil Code.
The withdrawal period begins on the day following the day on which the Buyer receives the goods. If the Buyer orders several items of goods within a single order that are delivered separately, the withdrawal period begins on the day following the day on which the Buyer receives the last item of goods.
The Buyer must notify the Seller of the withdrawal from the contract no later than the last day of the applicable withdrawal period. The withdrawal may be submitted in particular by email or in writing to the Seller's contact address specified in these
Terms and Conditions. The Buyer is not required to state a reason for the withdrawal. Following withdrawal from the contract, the Buyer must send or hand over the goods to the Seller without undue delay and no later than 14 days from the withdrawal from the contract. The costs associated with returning the goods shall be borne by the Buyer, unless otherwise agreed with the Seller.
The Seller shall refund to the Buyer, without undue delay and no later than 14 days from the withdrawal from the contract, all funds received from the Buyer, including the cost of delivery of the goods. However, the Seller is not obliged to refund the funds before receiving the returned goods or before the Buyer proves that the goods have been sent back.
The Seller shall reimburse the Buyer for the cost of delivery only up to the amount

corresponding to the cheapest delivery method offered by the Seller. If the Buyer chose a more expensive delivery method, only the amount corresponding to the cheapest delivery method shall be refunded.

10. The Buyer shall be liable for any reduction in the value of the goods resulting from handling the goods in a manner other than what is necessary to familiarize themselves with the nature, characteristics and functionality of the goods.

11. The right to withdraw from the contract does not apply where such right is excluded by law, in particular in the case of goods that have been modified according to the Buyer's requirements or customized to the Buyer's personal needs pursuant to Section 1837 of the Civil Code.

VII. Complaints

Statutory liability of the Seller for defects applies to the delivered goods, in accordance with the Civil Code and the Consumer Protection Act.
The Buyer may file a complaint via e-mail to info@tram.photos.
The Seller undertakes to assess and settle the complaint without undue delay, no later than within 30 days.
If the Seller acknowledges the complaint, he will remedy the defect by repair or replacement, or, according to the nature of the defect, grant a reasonable discount or refund the corresponding part of the price.

VIII. Commercial Communications

If the Buyer actively ticks the consent to receive news and commercial communications, he will be added to the list of persons to whom such information is sent. The Buyer may unsubscribe from this list at any time.
Commercial communications are sent exclusively by the Seller and relate exclusively to the goods and services of the tram.photos e-shop or other services of the Seller. The Seller will never provide, sell or hand over the Buyer’s contact details to any third party for the purpose of marketing, advertising or sending commercial communications of third parties.

IX. Liability and Limitations

The Seller provides all information in good faith and does not guarantee its completeness or up-to-dateness.
The Seller is not liable for damage arising from the use of information from the e-shop.
The Seller reserves the right to temporarily or permanently restrict the operation of the e-shop for technical reasons.
The Seller reserves the right to change the scope and prices of the offered goods. The Buyer will be informed about significant changes by e-mail.

X. Personal Data Protection (GDPR)

The controller of personal data is the Seller of the tram.photos e-shop. The identification details of the controller (Marek Mantič, ID 06722245, Hlavní třída 1023/55, 708 00 Ostrava-Poruba, Czech Republic) are stated in the Contact section. Contact e-mail: info@tram.photos.
Processed personal data:

when registering: first name, surname, e-mail address, telephone;
when purchasing: order and payment details (amount, date, status), invoicing and delivery details.

3. Purpose of processing:

performance of a contract – processing and delivery of goods, provision of e-shop services;
fulfilment of legal obligations – issuing tax documents, bookkeeping;
sending commercial communications – based on the Buyer’s consent, exclusively communications of the Seller and his projects;
legitimate interest of the Seller – securing the e-shop, prevention of misuse, traffic analysis.

4. Period of retention:

invoicing data and tax documents: for the period set by law (at least 10 years under the accounting act);
login logs and IP addresses: maximum 12 months.

5. Transfer of data to third parties:

carrier (Zásilkovna or transporter) – exclusively for the purpose of delivering the shipment;
PayU payment gateway (PayU S.A.) – exclusively for the purpose of processing the payment.

6. The Seller does not transfer, sell or provide personal data of Buyers to any other third parties, not even for the purpose of marketing, advertising or commercial communications of third parties.

7. Rights of the Buyer (data subject):

the right of access, rectification and erasure („the right to be forgotten") of data,
with the exception of data kept on the basis of a legal obligation;
the right to restriction of processing, data portability and the right to object;
the right to withdraw consent to processing, in particular consent to the sending
of commercial communications.

XI. Cookies

The e-shop uses technical (necessary) cookies to ensure login and the correct functioning of the service (for example the cart content).
The e-shop does not use cookies of third parties for advertising purposes.

XII. Final Provisions

The Seller reserves the right to change these T&C unilaterally. The Buyer will be informed about the changes by e-mail or by a notice on the e-shop.
The courts of the Czech Republic have jurisdiction to resolve disputes.
In accordance with the Consumer Protection Act, the Buyer is entitled, in the event of a consumer dispute, to also contact the Czech Trade Inspection, which is the body for the out-of-court settlement of consumer disputes.
These T&C become effective as of 8 August 2026.
